More About the Law
Nebraska’s Governor signed into law on May 20, 2025 The Safe Battery Collection and Recycling Act (LB 36). Under Nebraska’s Act, producers of covered batteries and battery-containing products sold or offered for sale in Nebraska must be a member of a Battery Stewardship Organization. As of January 1, 2028 producers are required to comply with the battery disposal ban. The law requires battery producers to fund and operate a program that provides convenient, free collection and recycling of covered portable and medium-format batteries, including damaged or defective batteries, across Nebraska. The Battery Network will submit its stewardship plan to the Nebraska’s Department of Energy and Environment by the January 1, 2027 deadline, covering the more than 300 producers currently participating in the program. As a result, producers already participating in The Battery Network program will automatically be included in the Nebraska plan and do not need to take any additional action at this time.
